ACHIV TERMS OF USE

Please read these Terms of Use ("Terms") carefully before using the Achiv mobile application (the "App") operated by Achiv ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. ACCEPTANCE OF TERMS

By accessing or using Achiv, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. DESCRIPTION OF SERVICE

Achiv is a personal productivity application that allows you to:

  • Create, organize, and manage tasks and checklists

  • Set and track goals linked to your tasks

  • View daily progress

  • Set reminders and recurring task schedules

  • Import events from your local device calendar

All data is stored locally on your device. Achiv does not operate cloud servers and does not sync your data across devices.

3. USER ACCOUNTS

Achiv does not require account creation, registration, or sign-in. Your use of the App is tied solely to the device on which it is installed.

4. SUBSCRIPTIONS AND PAYMENTS

4.1 Free Tier

Achiv offers limited functionality at no cost, including up to 3 tasks per day.

4.2 Achiv Premium

Achiv Premium is available as an auto-renewable subscription with the following plans:

  • Monthly: Billed monthly at the price displayed at time of purchase.

  • Yearly: Billed annually at the price displayed at time of purchase. Includes a 3-day free trial for eligible users.

4.3 Billing

All payments are processed through Apple's App Store. By purchasing a subscription, you agree to Apple's payment terms. We do not collect, process, or store any payment or billing information.

4.4 Free Trial

If you are eligible for a free trial, your subscription will begin with a 3-day free trial period. You will not be charged during the trial. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged the applicable subscription price.

4.5 Renewal and Cancellation

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

  • You may manage or cancel your subscription at any time through your Apple ID account settings or through the App's Settings screen.

  • Cancellation takes effect at the end of the current billing period. You will retain access to Achiv Premium features until that period expires.

  • No refunds are provided for partial billing periods.

4.6 Price Changes

We reserve the right to modify subscription pricing. Any price changes will take effect at the start of the next billing cycle following notice provided through the App or the App Store.

5. ACCEPTABLE USE

You agree to use Achiv solely for lawful, personal, and non-commercial purposes. You agree not to:

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App

  • Modify, adapt, translate, or create derivative works based on the App

  • Distribute, license, sell, rent, lease, or lend the App to any third party

  • Use the App in any manner that could damage, disable, overburden, or impair the App

  • Remove, alter, or obscure any proprietary notices, labels, or marks on the App

  • Use the App for any illegal, harmful, or fraudulent purpose

6. INTELLECTUAL PROPERTY

The App, including but not limited to its design, code, graphics, logos, icons, user interface, and all content and materials therein, is the exclusive property of Achiv and is protected by applicable copyright, trademark, and intellectual property laws.

These Terms do not grant you any ownership rights in the App. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal purposes in accordance with these Terms.

7. DATA AND PRIVACY

Your use of Achiv is also governed by our Privacy Policy, which describes how we handle your information. By using the App, you acknowledge that you have read and understood our Privacy Policy.

All data you create within Achiv is stored locally on your device. We do not access, collect, or transmit your personal data. You are solely responsible for maintaining and backing up your device data.

8. DATA LOSS

Because all data is stored locally on your device, we are not responsible for any loss of data resulting from:

  • Device damage, loss, or theft

  • Operating system updates or device resets

  • App deletion or re-installation

  • Any other event outside our reasonable control

We recommend maintaining regular backups of your device through Apple's iCloud or iTunes backup services.

9. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE APP IS AT YOUR SOLE RISK.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ACHIV, ITS OWNERS, OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Achiv, its owners, officers, employees, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the App or your violation of these Terms.

12. TERMINATION

We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to the App, other users, or third parties, or for any other reason at our sole discretion.

Upon termination, your right to use the App will immediately cease. Sections 6, 8, 9, 10, 11, and 14 of these Terms shall survive any termination.

13. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. Any changes will be reflected by an updated "Last updated" date at the top of this page. Your continued use of the App after any modifications constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

14. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Arizona/Maricopa County, United States.

15. APPLE-SPECIFIC TERMS

These Terms are between you and Achiv, not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content. In the event of any conflict between these Terms and Apple's App Store Terms of Service, Apple's terms shall prevail with respect to your use of the App Store. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.

16. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms shall remain in full force and effect.

17. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Achiv regarding the use of the App and supersede any prior agreements, communications, or understandings, whether written or oral.
